Two Tier Kier again on Section 21
I was surprised to read that Hackney council had "seized" (repossessed) seven properties.
No Section 21. No Section 8. They simply turned up and seized the properties back. No court warrant - nothing.
The grounds for seizing them was that the tenants were fraudsters.
Now I've had a fraudulent tenant in the past. I couldn't simply seize the property. My fraudulent tenant even managed to get legal aid via Shelter to fight me and run up a huge legal bill.
If this situation happened to me again I would make sure criminal proceedings were brought against the tenant for fraud. Fraud is a criminal act. For example if the tenant makes up disrepair claims , then make in clear in the legal documentation that this is fraudulent. You can then bring CRIMINAL proceedings.
Shelter encourage the tenants they are representing to stray from the truth - basically they are encouraging fraud. I have evidence of this as the tenant in question I evicted left all the Shelter paperwork - the only positive thing I can say about my eviction experience other than the relief of getting my property back after 1 year.
Shelter - if you are reading then feel free to start legal action against me so I can prove in court you encourage fraud.
The Solicitor Regulation Authority takes a very dim view of solicitors who are complicit with their client in misleading the court and therefore the solicitors risk serious consequences. Shelter themselves would be criminally liable.
Back to Section 21. Labour MP Nadia Whittome for Nottingham East has demanded section 21 eviction notices be withdrawn for her constituents. She goes on to say they are struggling to secure affordable accomodation.
So basically the tenants had below market rents and now they cant find anything at that price - what a surprise. Nottingham council is well known for being anti-Landlord.
The Landlords have had enough of government meddling and wants their properties back.
Is Nadia going to give the landlords the £391 court fee for each tenant if the Landlord withdraws the Section 21? I doubt it.
When politicians create a toxic anti landlord culture (bullying culture) dont be surprised if the landlords sell-up and move on.
Shelter has now turned on Starmer as section 21 evictions still exist. Shelter know the court system is broken and they dislike Section 21 because it's light touch with little court time to process. Section 8 requires a court hearing so by making all evictions section 8 it will overload the already broken court system meaning scumbag tenants can stay potentially several years in the property without paying rent. Landlords can't just go seize properties like Hackney council.
How many homeless people does Shelter house? Zero
How many tenanted properties does Shelter have? Zero
Get the idea - they dont practice what they preach. Their approach to Homelessness is to make Landlords charities by giving rogue tenants free accomodation.
Maybe victim landlords can declare themselves charities whilst they house the homeless.
